policies.Members
have
used
this
languageasaguideincreatingwrittenpoliciesandprocedurescoveringthecompany
’
employmentpracticesandphilosophies.
Thispublication,likeothersbeforeit,doesnotclaimtobeall-inclusiveorafinalproduct.NewStateandFederallawsandlegaldecisionswillrequirethissampletobeupdated,alongwiththecompany'semployeehandbook,toreflectthesechanges.Further,eachcompanymustdevelopanemployeehandbook,whichreflectstheemploymentpractices
uniquetothecompany'soperationandphilosophies.Consequently,apublicationsuchasthissamplemustbeflexibleandopenendedtoaccommodatethesedifferencesinemploymentpracticesandphilosophies.
Ininitiatingorrevisingyourcompanypersonnelpoliciesoremployeehandbook,donothesitatetocallDougMoore,VicePresidentofHumanResources,forassistance.
Althoughanefforthasbeenmadetoprovidesamplelanguage,whichisconsistentwithapplicablelaw,employersusingthisorotherlanguagemaywishtohavealaborattorneyreviewtheiremployeehandbookbeforepublication.
PICwouldliketoextendaspecialthankstotheEmploymentLawDepartmentat
thelawfirmofSilver&Freedman.Theyhaveprovidedagoodportionofthelanguagecontainedinthissamplehandbookandreviewitscontentsfromtimetotime.

TheCaliforniaWorkers’CompensationAppealsBoard(WCAB)hasdecidedNavarroinv.
A&AFarmingthatanemployerwhosepersonnelpolicyterminatedbenefitsafterastatedperiodcouldapplythepolicytopersonsontemporaryWorkers’Compdisability.A&AFarmingobtaineditscoveragefromtheWesternGrowersTrust,aCalifornialicensedMEWA,asisthePIASC,PINCandPIASDBenefitTrusts,soitisclearthatthedecisionappliestothosefirmswhoobtainhealthcoveragefromthePIASC,PINCorPIASDBenefitTrusts.FirmsthatdonotobtaintheircoveragefromtheBenefitTrustmayprobablyrelyonthesamedecision,butitislesscertain.Ifhealthcoverageceasesundersuchapolicy,affectedemployees(infirmsoftwoormoreemployees)becomeeligibleforCOBRAextension.
Companiescanchoosetomakeemployerpaymentsformoreorlesstimethanthe12weekssuggestedinthesamplelanguagewiththefollowingexceptions:
CompaniescoveredbytheFamilyandMedicalLeaveActmustpayforatleast12weeks,andallcompaniesmust
payforupto31daysforemployeesactivatedformilitaryservice.Thecompany’spolicypaymentsshouldbethesameforallleavesthecompanygrantssoasnottobediscriminatory.
