THISAGREEMENTisbetween
(1)[Companyname]whoseRegisteredOfficeisat[Registeredaddressofthecompany],(“theEmployer”)and
(2)[Nameofemployee]of[Addressofemployee](“theEmployee”)
ITISAGREEDthattheEmployerwillemploytheEmployeeandtheEmployeewillworkfortheEmployeronthefollowingtermsandconditions:
1.Jobtitle
TheEmployee’spositionisthatof[Jobtitle].
TheEmployeemayfromtimetotimeberequiredtocarryoutsuchotherreasonabledutiesastheEmployermaydecide,withoutadditionalremuneration,shouldthisbenecessarytomeettheneedsofthebusiness.
2.Commencementandcontinuityofemployment
TheEmployee’semploymentwiththeEmployerbeganon[Date].
TheEmployee’scontinuousemployment,takingintoaccountanyservicewithEmployerandwithanypreviousemployerwhichcounts,beganon[Date].
3.Probationaryperiod
Thefirst[Probationaryperiod]ofemploymentwillbeaprobationaryperiod,duringwhichtheEmployee’sperformancewillbemonitored.TheprobationaryperiodmaybeextendedbytheEmployer.Duringtheprobationaryperiodthisemploymentmaybeterminatedbyeitherpartygivingoneweek’snoticetotheotherinwriting.
4.Hoursofwork
TheEmployee’snormalworkinghoursare:
Mondayfromto
Tuesdayfromto
Wednesdayfromto
Thursdayfromto
Fridayfromto
Saturdayfromto
Sundayfromto
Thisisatotalof[Number]hoursperweek.
TheEmployeemayberequiredtoworksuchfurtherhoursasmaybenecessarytofulfilhis/herdutiesortheneedsofthebusiness.Wheneverpossible,[Responsiblemanager]willgivetheEmployeereasonablenoticeofanyadditionalhours.
*Iftheemployeehasagreedtoworkinexcessofthe48hourweeklyworkingtimelimit,prescribedbytheWorkingTimeRegulations,includethefollowingparagraph.
[TheEmployeeagreesthathis/heraverageweeklyworkinghoursmaybeinexcessofthoseprescribedbylaw(“theWaiver”).TheWaiverwillremaininforceindefinitelybuttheEmployeemaygivetheEmployernotlessthanthreemonths’noticeinwritingofhis/herintentiontoterminatetheWaiver.]
TheEmployeeisentitledtoanunpaidlunchbreakof[Lengthoflunchbreak]whichwillbetakenatsuchtimeastheEmployermayrequire.
Forpart-timeemployees,entitlementtoholidays,sickpay,andallotherbenefitsisproratabasedonthehoursworkedcomparedtothoseworkedbyafulltimeemployee.Fulltimehoursforthispurposeare[Number]perweek.
5.Placeofwork
TheEmployee’snormalplaceofworkwillbe[Actualplaceofwork].

6.Payment

7.Deductionsfromwages
TheEmployershallbeentitledtosuspendtheEmployee’semploymentwithoutpayintheeventoftheEmployeerefusingtoobeyalawfulorderincluding(butnotrestrictedto)thosegiventocomplywiththeEmployer'sstatutoryobligations.
TheEmployerreservestherightandtheEmployeeirrevocablyauthorisestheEmployer,atanytimeduringtheEmployee’semployment,orinanyeventupontermination,todeductfromtheEmployee’swages/salaryand/oranyothermoniesduetotheEmployee,anamountequivalenttoanyofthefollowing:
(i)anyoverpaymentofwages,salary,remunerationorotherpaymentmadetotheEmployeeduringthecourseofthisemployment;
(ii)theamountofanyexpensesclaimedbytheEmployeeandpaidbutsubsequentlydisallowedbytheEmployer,
(iii)theoutstandingamountofanyloanoradvancemadebytheEmployertotheEmployee;and
(iv)anycostofrepairinganydamagetoorlossofpropertyof,anyfinesorchargesimposeduponoranyotherlosssustainedbytheEmployeroranythirdparty,causedbytheEmployee’sbreachofcontractorbreachoftheEmployer’srulesorasaresultoftheEmployee’snegligenceordishonesty.
8.Pension
*WherethereisaCompanypensionscheme,includethefollowingparagraph.
[TheEmployeemay,ifhe/shewishes,afterthecompletionof[Numberofweeks/months]continuousemployment,joinandremainduringthecontinuanceofhis/heremploymentamemberoftheEmployer’spensionscheme,asappropriatefromtimetotimetoemployeesofhis/hercategory.Furtherdetailsofthepensionschemeareavailablefrom[Informationprovider].]
*Wherethereisnocompanypensionschemebuttheemployerwillmakeacontributiontotheemployee’spersonalpension,includethefollowingparagraph.
[Afterthecompletionof[Numberofweeks/months]continuousemployment,theEmployerwillcontribute[Number]%oftheEmployee’sbasicwages/salary(notincludingovertime,bonusorcommissionpayments)toapersonalpensionplanoftheEmployee’schoice,approvedbytheEmployer,(suchapprovalnottobeunreasonablywithheld.]

9.Benefits
Afterthecompletionof[Numberofweeks/months]continuousemployment,theEmployeewillbeentitledto[Detailsofcompanybenefits].
10.Expenses
TheEmployerwillreimburseallreasonableout-of-pocketexpensesincurredbytheEmployeeduringtheoperationofhis/herdaytodayduties,subjecttoproduction,withinonemonth,ofwrittenevidenceofexpenditure,whereprocurable.
11.Holidays
*Ifbankandpublicholidaysaregiveninadditiontoannualholidayentitlement,includethefollowing.
[Inadditiontobankandpublicholidays,theEmployee’sannualholidayentitlementis[Numberofdays].]
*Ifbankandpublicholidaysareincludedinannualholidayentitlement,includethefollowing.

Holidayentitlementforpart-timeemployeesisprorata,basedonthenumberofhoursworkedcomparedwiththoseworkedbyafull-timeemployee.
Theholidayentitlementwillbetakenatdatesagreedwith[Responsiblemanager].TheEmployeemustgiveatleastoneweek’snoticeofholidayrequestsandwhilsteveryendeavourwillbemadetoco-operatewiththeEmployeeinfixingtheholidaydates,suchdateswillremainintheultimatediscretionoftheEmployer.TheEmployerwillgivetheEmployeeatleastoneweek’snoticeifhe/sheisrequiredtotakeholidayotherthanduringnotice.
Holidaysmustbetakenintheholidayyearofentitlementandmaynotbecarriedforwardtothefollowingyear.
Theholidayyearrunsfrom[Holidayyearstartmonth].
PublicholidaysmaybesubstitutedbyorbyagreementwiththeEmployer.
TheEmployerreservestherighttorequiretheEmployeetotakeanyunusedholidayduringhis/hernoticeperiod,evenifbookedtobetakenaftertheendofthenoticeperiod.
*IftheemployerhasashutdownperiodforexampleduringthesummerorbetweenChristmasandNewYear,includethefollowing.
[TheEmployeeisrequiredtoretainasufficientnumberofholidaysfromhis/herannualentitlementtocovertheEmployer’s[Timeofshutdown:
summer/Christmas]shutdownperiod.ThenumberofdaysholidaytoberetainedforthispurposewillbenotifiedbytheEmployerbywayofageneralnotice.]
12.Holidaypayment
Holidaypaywillbepaidatthebasicrate.
Uponterminationofemployment,theEmployeewillbeentitledtopayinlieuofanyunusedholidayentitlementorberequiredtopaytotheEmployerpayreceivedforholidaytakeninexcessofholidayentitlement.AnysumssoduemaybedeductedfromanymoneyowingtotheEmployeeandtheEmployeeirrevocablyauthorisestheEmployertomakesuchdeductions.
ForthepurposeofcalculatinganyholidaypayduetotheEmployeeorowedbytheEmployeetotheEmployer,oneday’spayshallbe
*Includeeither,forweeklypaidemployees
[theEmployee’sbasicweeklypaydividedby5or,iftheEmployeeispart-time,bythenumberofdaysperweeknormallyworked.]

[theEmployee’smonthlypaydividedby22,or,iftheEmployeeispart-time,bythenumberofdayspermonthnormallyworked.]
*Or,foremployeeswhoarepaidanannualsalary

ThisprovisionshallexcludetheApportionmentAct1870.
13.Absencesduetosicknessorinjury
IntheeventofincapacityduetosicknessorinjurytheEmployeemustadvise[Responsiblemanager]notlaterthan[Timetoreportsick]onthefirstdayofabsence.Fullreasonsmustbegivenat
