onend-oflifevehicles
THEEUROPEANPARLIAMENTANDTHECOUNCILOFTHEEUROPEANUNION,
HavingregardtotheTreatyestablishingtheEuropeanCommunity,andinparticularArticle175
(1)thereof,
HavingregardtotheproposalfromtheCommission
(1),
HavingregardtotheopinionoftheEconomicandSocialCommittee
(2),
HavingconsultedtheCommitteeoftheRegions,
ActinginaccordancewiththeprocedurereferredtoinArticle251oftheTreatyinthelightofthejointtextapprovedbytheConciliationCommitteeon23May2000(3),
Whereas
(1)Thedifferentnationalmeasuresconcerningend-oflifevehiclesshouldbeharmonisedinorder,first,tominimisetheimpactofend-oflifevehiclesontheenvironment,thuscontributingtotheprotection,preservationandimprovementofthequalityoftheenvironmentandenergyconservation,and,second,toensurethesmoothoperationoftheinternalmarketandavoiddistortionsofcompetitionintheCommunity.
(2)ACommunity-wideframeworkisnecessaryinordertoensurecoherencebetweennationalapproachesinattainingtheobjectivesstatedabove,particularlywithaviewtothedesignofvehiclesforrecyclingandrecovery,totherequirementsforcollectionandtreatmentfacilities,andtotheattainmentofthetargetsforreuse,recyclingandrecovery,takingintoaccounttheprincipleofsubsidiarityandthepolluter-paysprinciple.
(3)Everyyearend-oflifevehiclesintheCommunitygeneratebetween8and9milliontonnesofwaste,whichmustbemanagedcorrectly.
(4)InordertoimplementtheprecautionaryandpreventiveprinciplesandinlinewiththeCommunitystrategyforwastemanagement,thegenerationofwastemustbeavoidedasmuchaspossible.
(5)Itisafurtherfundamentalprinciplethatwasteshouldbereusedandrecovered,andthatpreferencebegiventoreuseandrecycling.
(6)MemberStatesshouldtakemeasurestoensurethateconomicoperatorssetupsystemsforthecollection,treatmentandrecoveryofend-oflifevehicles.
(7)MemberStatesshouldensurethatthelastholderand/orownercandelivertheend-oflifevehicletoanauthorisedtreatmentfacilitywithoutanycostasaresultofthevehiclehavingnooranegative,marketvalue.MemberStatesshouldensurethatproducersmeetall,orasignificantpartof,thecostsoftheimplementationofthesemeasures;thenormalfunctioningofmarketforcesshouldnotbehindered.
(8)ThisDirectiveshouldcovervehiclesandend-oflifevehicles,includingtheircomponentsandmaterials,aswellasspareandreplacementparts,withoutprejudicetosafetystandards,airemissionsandnoisecontrol.
(9)ThisDirectiveshouldbeunderstoodashavingborrowed,whereappropriate,theterminologyusedbyseveralexistingdirectives,namelyCouncilDirective67/548/EECof27June1967ontheapproximationoflaws,regulationsandadministrativeprovisionsrelatingtotheclassification,packagingandlabellingofdangeroussubstances(4),CouncilDirective70/156/EECof6February1970ontheapproximationofthelawsoftheMemberStatesrelatingtothetype-approvalofmotorvehiclesandtheirtrailers(5),andCouncilDirective75/442/EECof15July1975onwaste(6).
(10)Vintagevehicles,meaninghistoricvehiclesorvehiclesofvaluetocollectorsorintendedformuseums,keptinaproperandenvironmentallysoundmanner,eitherreadyforuseorstrippedintoparts,arenotcoveredbythedefinitionofwastelaiddownbyDirective75/442/EECanddonotfallwithinthescopeofthisDirective.
(11)Itisimportantthatpreventivemeasuresbeappliedfromtheconceptionphaseofthevehicleonwardsandtaketheform,inparticular,ofreductionandcontrolofhazardoussubstancesinvehicles,inordertopreventtheirreleaseintotheenvironment,tofacilitaterecyclingandtoavoidthedisposalofhazardouswaste.Inparticulartheuseoflead,mercury,cadmiumandhexavalentchromiumshouldbeprohibited.Theseheavymetalsshouldonlybeusedincertainapplicationsaccordingtoalistwhichwillberegularlyreviewed.Thiswillhelptoensurethatcertainmaterialsandcomponentsdonotbecomeshredderresidues,andarenotincineratedordisposedofinlandfills.
(12)Therecyclingofallplasticsfromend-oflifevehiclesshouldbecontinuouslyimproved.TheCommissioniscurrentlyexaminingtheenvironmentalimpactsofPVC.TheCommissionwill,onthebasisofthiswork,makeproposalsasappropriateastotheuseofPVCincludingconsiderationsforvehicles.
(13)Therequirementsfordismantling,reuseandrecyclingofend-oflifevehiclesandtheircomponentsshouldbeintegratedinthedesignandproductionofnewvehicles.
(14)Thedevelopmentofmarketsforrecycledmaterialsshouldbeencouraged.
(15)Inordertoensurethatend-oflifevehiclesarediscardedwithoutendangeringtheenvironment,appropriatecollectionsystemsshouldbesetup.
(16)Acertificateofdestruction,tobeusedasaconditionforthede-registrationofend-oflifevehicles,shouldbeintroduced.MemberStateswithoutade-registrationsystemshouldsetupasystemaccordingtowhichacertificateofdestructionisnotifiedtotherelevantcompetentauthoritywhentheend-oflifevehicleistransferredtoatreatmentfacility.
(17)ThisDirectivedoesnotpreventMemberStatesfromgranting,whereappropriate,temporaryderegistrationsofvehicles.
(18)Collectionandtreatmentoperatorsshouldbeallowedtooperateonlywhentheyhavereceivedapermitor,incasearegistrationisusedinsteadofapermit,specificconditionshavebeencompliedwith.
(19)Therecyclabilityandrecoverabilityofvehiclesshouldbepromoted.
(20)Itisimportanttolaydownrequirementsforstorageandtreatmentoperationsinordertopreventnegativeimpactsontheenvironmentandtoavoidtheemergenceofdistortionsintradeandcompetition.
(21)Inordertoachieveresultsintheshorttermandtogiveoperators,consumersandpublicauthoritiesthenecessaryperspectiveforthelongerterm,quantifiedtargetsforreuse,recyclingandrecoverytobeachievedbyeconomicoperatorsshouldbeset.
(22)Producersshouldensurethatvehiclesaredesignedandmanufacturedinsuchawayastoallowthequantifiedtargetsforreuse,recyclingandrecoverytobeachieved.TothisendtheCommissionwillpromotethepreparationofEuropeanstandardsandwilltaketheothernecessarymeasuresinordertoamendthepertinentEuropeanvehicletype-approvallegislation.
(23)MemberStatesshouldensurethatinimplementingtheprovisionsofthisDirectivecompetitionispreserved,inparticularasregardstheaccessofsmallandmedium-sizedenterprisestothecollection,dismantling,treatmentandrecyclingmarket.
(24)Inordertofacilitatethedismantlingandrecovery,inparticularrecyclingofend-oflifevehicles,vehiclemanufacturersshouldprovideauthorisedtreatmentfacilitieswithallrequisitedismantlinginformation,inparticularforhazardousmaterials.
(25)ThepreparationofEuropeanstandards,whereappropriate,shouldbepromoted.Vehiclemanufacturersandmaterialproducersshouldusecomponentandmaterialcodingstandards,tobeestablishedbytheCommissionassistedbytherelevantcommittee.InthepreparationofthesestandardstheCommissionwilltakeaccount,asappropriate,oftheworkgoingoninthisareaintherelevantinternationalforums.
(26)Community-widedataonend-oflifevehiclesareneededinordertomonitortheimplementationoftheobjectivesofthisDirective.
(27)Consumershavetobeadequatelyinformedinordertoadjusttheirbehaviourandattitudes;tothisendinformationshouldbemadeavailablebytherelevanteconomicoperators.
(28)MemberStatesmaychoosetoimplementcertainprovisionsbymeansofagreementswiththeeconomicsectorconcerned,providedthatcertainconditionsaremet.
(29)Theadaptationtoscientificandtechnicalprogressoftherequirementsfortreatmentfacilitiesandfortheuseofhazardoussubstancesand,aswellastheadoptionofminimumstandardsforthecertificateofdestruction,theformatsforthedatabaseandtheimplementationmeasuresnecessarytocontrolcompliancewiththequantifiedtargetsshouldbeeffectedbytheCommissionunderaCommitteeprocedure.
(30)ThemeasurestobetakenfortheimplementationofthisDirectiveshouldbeadoptedinaccordancewithCouncilDecision1999/468/ECof28June1999layingdowntheproceduresfortheexerciseofimplementingpowersconferredontheCommission(7).
(31)MemberStatesmayapplytheprovisionsofthisDirectiveinadvanceofthedatesetouttherein,providedsuchmeasuresarecompatiblewiththeTreaty,
HAVEADOPTEDTHISDIRECTIVE:
Article1
Objectives
ThisDirectivelaysdownmeasureswhichaim,asafirstpriority,atthepreventionofwastefromvehiclesand,inaddition,atthereuse,recyclingandotherformsofrecoveryofend-oflifevehiclesandtheircomponentssoastoreducethedisposalofwaste,aswellasattheimprovementintheenvironmentalperformanceofalloftheeconomicoperatorsinvolvedinthelifecycleofvehiclesandespeciallytheoperatorsdirectlyinvolvedinthetreatmentofend-oflifevehicles.
Article2
Definitions
ForthepurposesofthisDirective:
1."vehicle"meansanyvehicledesignatedascategoryM1orN1definedinAnnexIIAtoDirective70/156/EEC,andthreewheelmotorvehiclesasdefinedinDirective92/61/EEC,butexcludingmotortricycles;
2."end-oflifevehicle"meansavehiclewhichiswastewithinthemeaningofArticle1(a)ofDirective75/442/EEC;
3."producer"meansthevehiclemanufacturerortheprofessionalimporterofavehicleintoaMemberState;
4."prevention"meansmeasuresaimin
