ARTICLE82.Coverage.–TheprovisionsofthisTitleshallapplytoemployeesinallestablishmentsandundertakingswhetherforprofitornot,butnottogovernmentemployees,managerialemployees,fieldpersonnel,membersofthefamilyoftheemployerwhoaredependentonhimforsupport,domestichelpers,personsinthepersonalserviceofanother,andworkerswhoarepaidbyresultsasdeterminedbytheSecretaryofLaborinappropriateregulations.
Asusedherein,“managerialemployees”refertothosewhoseprimarydutyconsistsofthemanagementoftheestablishmentinwhichtheyareemployedorofadepartmentorsubdivisionthereof,andtootherofficersormembersofthemanagerialstaff.
“Fieldpersonnel”shallrefertonon-agriculturalemployeeswhoregularlyperformtheirdutiesawayfromtheprincipalplaceofbusinessorbranchofficeoftheemployerandwhoseactualhoursofworkinthefieldcannotbedeterminedwithreasonablecertainty.
ARTICLE83.Normalhoursofwork.–Thenormalhoursofworkofanyemployeeshallnotexceedeight(8)hoursaday.
Healthpersonnelincitiesandmunicipalitieswithapopulationofatleastonemillion(1,000,000)orinhospitalsandclinicswithabedcapacityofatleastonehundred(100)shallholdregularofficehoursforeight(8)hoursaday,forfive(5)daysaweek,exclusiveoftimeformeals,exceptwheretheexigenciesoftheservicerequirethatsuchpersonnelworkforsix(6)daysorforty-eight(48)hours,inwhichcase,theyshallbeentitledtoanadditionalcompensationofatleastthirtypercent(30%)oftheirregularwageforworkonthesixthday.ForpurposesofthisArticle,“healthpersonnel”shallincluderesidentphysicians,nurses,nutritionists,dietitians,pharmacists,socialworkers,laboratorytechnicians,paramedicaltechnicians,psychologists,midwives,attendantsandallotherhospital
orclinicpersonnel.
ARTICLE84.Hoursworked.–Hoursworkedshallinclude(a)alltimeduringwhichanemployeeisrequiredtobeondutyortobeataprescribedworkplace;and(b)alltimeduringwhichanemployeeissufferedorpermittedtowork.
Restperiodsofshortdurationduringworkinghoursshallbecountedashoursworked.
ARTICLE85.Mealperiods.–SubjecttosuchregulationsastheSecretaryofLabormayprescribe,itshallbethedutyofeveryemployertogivehisemployeesnotlessthansixty(60)minutestime-offfortheirregularmeals.
ARTICLE86.Nightshiftdifferential.–Everyemployeeshallbepaidanightshiftdifferentialofnotlessthantenpercent(10%)ofhisregularwageforeachhourofworkperformedbetweentenoclockintheeveningandsixoclockinthemorning.
ARTICLE87.Overtimework.–Workmaybeperformedbeyondeight(8)hoursadayprovidedthattheemployeeispaidfortheovertimework,anadditionalcompensationequivalenttohisregularwageplusatleasttwenty-fivepercent(25%)thereof.Workperformedbeyondeighthoursonaholidayorrestdayshallbepaidanadditionalcompensationequivalenttotherateofthefirsteighthoursonaholidayorrestdayplusatleastthirtypercent(30%)thereof.
ARTICLE88.Undertimenotoffsetbyovertime.–Undertimeworkonanyparticulardayshallnotbeoffsetbyovertimeworkonanyotherday.PermissiongiventotheemployeetogoonleaveonsomeotherdayoftheweekshallnotexempttheemployerfrompayingtheadditionalcompensationrequiredinthisChapter.
ARTICLE89.Emergencyovertimework.–Anyemployeemayberequiredbytheemployertoperformovertimeworkinanyofthefollowingcases:
(a)WhenthecountryisatwarorwhenanyothernationalorlocalemergencyhasbeendeclaredbytheNationalAssemblyortheChiefExecutive;
(b)Whenitisnecessarytopreventlossoflifeorpropertyorincaseofimminentdangertopublicsafetyduetoanactualorimpendingemergencyinthelocalitycausedbyseriousaccidents,fire,flood,typhoon,earthquake,epidemic,orotherdisasterorcalamity;
(c)Whenthereisurgentworktobeperformedonmachines,installations,orequipment,inordertoavoidseriouslossordamagetotheemployerorsomeothercauseofsimilarnature;
(d)Whentheworkisnecessarytopreventlossordamagetoperishablegoods;and
(e)Wherethecompletionorcontinuationoftheworkstartedbeforetheeighthhourisnecessarytopreventseriousobstructionorprejudicetothebusinessoroperationsoftheemployer.
AnyemployeerequiredtorenderovertimeworkunderthisArticleshallbepaidtheadditionalcompensationrequiredinthisChapter.
ARTICLE90.Computationofadditionalcompensation.–ForpurposesofcomputingovertimeandotheradditionalremunerationasrequiredbythisChapter,the“regularwage”ofanemployeeshallincludethecashwageonly,withoutdeductiononaccountoffacilitiesprovidedbytheemployer.
ChapterII
WEEKLYRESTPERIODS
ARTICLE91.Righttoweeklyrestday.–(a)Itshallbethedutyofeveryemployer,whetheroperatingforprofitornot,toprovideeachofhisemployeesarestperiodofnotlessthantwenty-four(24)consecutivehoursaftereverysix(6)consecutivenormalworkdays.
(b)TheemployershalldetermineandscheduletheweeklyrestdayofhisemployeessubjecttocollectivebargainingagreementandtosuchrulesandregulationsastheSecretaryofLaborandEmploymentmayprovide.However,theemployershallrespectthepreferenceofemployeesastotheirweeklyrestdaywhensuchpreferenceisbasedonreligiousgrounds.
ARTICLE92.Whenemployermayrequireworkonarestday.–Theemployermayrequirehisemployeestoworkonanyday:
(a)Incaseofactualorimpendingemergenciescausedbyseriousaccident,fire,flood,typhoon,earthquake,epidemicorotherdisasterorcalamitytopreventlossoflifeandproperty,orimminentdangertopublicsafety;
(b)Incasesofurgentworktobeperformedonthemachinery,equipment,orinstallation,toavoidseriouslosswhichtheemployerwouldotherwisesuffer;
(c)Intheeventofabnormalpressureofworkduetospecialcircumstances,wheretheemployercannotordinarilybeexpectedtoresorttoothermeasures;
(d)Topreventlossordamagetoperishablegoods;
(e)Wherethenatureoftheworkrequirescontinuousoperationsandthestoppageofworkmayresultinirreparableinjuryorlosstotheemployer;and
(f)UnderothercircumstancesanalogousorsimilartotheforegoingasdeterminedbytheSecretaryofLaborandEmployment.
ARTICLE93.Compensationforrestday,Sundayorholidaywork.-(a)Whereanemployeeismadeorpermittedtoworkonhisscheduledrestday,heshallbepaidanadditionalcompensationofatleastthirtypercent(30%)ofhisregularwage.AnemployeeshallbeentitledtosuchadditionalcompensationforworkperformedonSundayonlywhenitishisestablishedrestday.
(b)Whenthenatureoftheworkoftheemployeeissuchthathehasnoregularworkdaysandnoregularrestdayscanbescheduled,heshallbepaidanadditionalcompensationofatleastthirtypercent(30%)ofhisregularwageforworkperformedonSundaysandholidays.
(c)Workperformedonanyspecialholidayshallbepaidanadditionalcompensationofatleastthirtypercent(30%)oftheregularwageoftheemployee.Wheresuchholidayworkfallsontheemployeesscheduledrestday,heshallbeentitledtoanadditionalcompensationofatleastfiftypercent(50%)ofhisregularwage.
(d)WherethecollectivebargainingagreementorotherapplicableemploymentcontractstipulatesthepaymentofahigherpremiumpaythanthatprescribedunderthisArticle,theemployershallpaysuchhigherrate.
ChapterIII
HOLIDAYS,SERVICEINCENTIVELEAVESANDSERVICECHARGES
ARTICLE94.Righttoholidaypay.–(a)Everyworkershallbepaidhisregulardailywageduringregularholidays,exceptinretailandserviceestablishmentsregularlyemployinglessthanten(10)workers;
(b)Theemployermayrequireanemployeetoworkonanyholidaybutsuchemployeeshallbepaidacompensationequivalenttotwicehisregularrate;and
(c)AsusedinthisArticle,“holiday”includes:
NewYearsDay,MaundyThursday,GoodFriday,theninthofApril,thefirstofMay,thetwelfthofJune,thefourthofJuly,thethirtiethofNovember,thetwenty-fifthandthirtiethofDecemberandthedaydesignatedbylawforholdingageneralelection.
ARTICLE95.Righttoserviceincentiveleave.–(a)Everyemployeewhohasrenderedatleastoneyearofserviceshallbeentitledtoayearlyserviceincentiveleaveoffivedayswithpay.
(b)Thisprovisionshallnotapplytothosewhoarealreadyenjoyingthebenefithereinprovided,thoseenjoyingvacationleavewithpayofatleastfivedaysandthoseemployedinestablishmentsregularlyemployinglessthantenemployeesorinestablishmentsexemptedfromgrantingthisbenefitbytheSecretaryofLaborandEmploymentafterconsideringtheviabilityorfinancialconditionofsuchestablishment.
(c)Thegrantofbenefitinexcessofthatprovidedhereinshallnotbemadeasubjectofarbitrationoranycourtoradministrativeaction.
ARTICLE96.Servicecharges.–Allservicechargescollectedbyhotels,restaurantsandsimilarestablishmentsshallbedistributedattherateofeighty-fivepercent(85%)f
