Abstract:
UniversityRegulationsareanimportantpartoftheuniversitysystemconstruction,animportantmeansofuniversitymanagementisnecessarytomanagetheschool.Completeandreasonablerulesandregulations,thecollegeallworkonrule-based,teachingorderinordertomaintainstability,thequalityandefficiencyofeducationcanbeguaranteed.howeverunreasonableschoolrulesuncommon,theytendtoproducemanynegativeeffects,evenviolationsofthelegitimaterightsandinterestsofthestudentstheawakeningofCollegeStudents’awarenessoftheirrights,andtosafeguardtheirrightsandinterestsdemandsmoreintensethanbefore.therefore,onlyacontinualprocessofreflection,toimprovethecurrentlackofUniversityRegulations,andresolutelyimplementthe“student-oriented”managementphilosophy,inordertoensurethatstudentsmanageanorderly.

OfUniversityattachesgreatimportancetotheconstructionoftheschoolsystem,itisnotonlyameansandwaystomanage,ormanagetheschool’sneeds,embodiestheconceptofdemocraticmanagement,isthebasicguaranteeforthesuccessofanyorganization.Collegestudentsnewformsandnewchangesmakesmanagementdifficult,evenifeveryschoolhadcalledburdensomeandcomplexregulations,suchasPekingUniversityin2006<<undergraduatestudyandlifePracticalHandbook>>39managefilesinthere,butstillcannotdoeverything,issuesabound.
TherulesandregulationsofChineseUniversitiesstudentmanagementprocessUniversityRegulationsasanimportantmeansofstudentmanagement,notonlytoprotectthequalityofhighereducation,andtoensurethatcollegesanduniversitiestoachievethetrainingobjectives,butinrecentyearsanumberofcollegesanduniversitieslegaldisputesorlitigationreflectsfromonesideofUniversityRegulationsalsosomedeep-seatedproblemsthatexist.
ContentlawconflictswiththehostUniversitieslitigationisgrowing,thepartiesdebatefocusedonthelegalityoftherulesandregulations,especiallyinthecontentontheconflictwiththehostlawthelegitimacyofthesubstantiveaspectsoftheUniversityRegulations,theUniversityRegulationsshouldnotconflictwiththeprovisionsoftheupperlaw.LegislationLawofChinaclearlystipulateswhatisaconflictwiththehigher-levellaws,butpointedoutthatthefollowingsituationsshouldbeclassifiedas“inconsistent:
theupperlawclearlydefinedlegislativelawexpertZhangChunsheng,withmeasuresunderthepolicyof“higher-levellawsontheupperlawcontrarytotheprovisions,althoughnotcontrarytotheprovisionsofthehigher-levellaws,buttheupperlawprovisionsdesignedtooffset,thatis,toengagein”notclearlydefined,withthelegislativepurposeofthehigher-levellawsandcontrarytothespiritofthelegislation,inviolationoftheprovisionsofthelegislativeauthorityoftheLegislationLaw,ultravireslegislation,lowerlevellawexceedsthehigherlevellawthetypeandmagnitudeofthepunishment.complywithanyoftheabovefiveareconsideredtobethehostwearscontraveneUniversityRegulationsasgeneralnormativedocumentsoftheschool,thedevelopmentoflawsandregulationsonthebasisofthemainconstitution<<EducationLawofthePeople’sRepublicofChina>><<LawonHigherEducationofthePeople’sRepublicofChina>><<ordinarycollegestudentmanagementregulations>>,andso,therefore,ofUniversityRegulationswithinthescopeofthepowersconferredbylawdoesnotexceedshallnotbecontrarytothepurposeandspiritofthelegislationandthelawsandregulations,andcontent.
However,inpractice,somecollegesanduniversitiesinordertofacilitatemanagement,establishagoodstyleofstudy,schoolspirit,orlackoflegalawarenessandliteracyoverlookedwhenformulatingtherulesandregulationsandthecoordinationoftheupperlawin2003astheHenanUniversitystudentsgoouttowork-studyschoolfindsitsviolationoftherelevantprovisionsof<<studentmanagementrules>>andschoolauthoritiestocombatSARS,andmakethepunishmentofexpulsion.,suchasin2003,ShenzhenUniversityannouncedstudents<<behaviorcodeofethicsManagementOrdinance>draftproposedbancollegestudentsinschoolshand,hugthewaist,hugging,kissingandgirlswearlow-cuthalterOtherwise,thewillpointsystemintheformofpunishmentforoffendingstudents,whodeductionof30pointswillbeorderedtoleave.butnotdisposeofreasons,includingthetwocasesinvolved27providedfordrop-outinsixcasesand54expelledsixscenarios>><<Collegestudentmanagementregulationssimilarnumerouscases,theyarenothingbutreflectcollegeschoolrulesexistincontentinconsistentwithotherrelevantlawsandregulations,theproblemofconflict.
2.LackofstrictprocedurallimitationsUniversityRegulationsestablishproceduresshouldhavelegitimacy,whichisanecessaryconditiontoensurethecollegerulesandregulationsbinding,enforceableandnormativeChina’srelevantlawsandauthorizeduniversitiestoallowthecollegereferencetotheConstitutionandrelevantlawsandthedevelopmentofinternalmanagementregulations.Butthespecificprogramforcollegesanduniversitiestodevelopregulationsnotclearlydefined.However,theUniversityRegulationsstillaconventionalformulation:

3.NeglectthelegitimaterightsandinterestsofthestudentsCurrently,collegesanduniversitiesintheformulationandimplementationofrulesandregulations,oftenstartingfromtheneedsandobjectivesofmanagement,thevalueofitsStatuteandefficiency,orjuststressedthatstudentsshouldcomplywiththeobligations,ignoringtherightsofstudents,althoughtheschooldeveloptheoriginalintentionoftherulesandregulationsinordertobetterteachingandeducating,butdoesnotjustifythemeansoflegitimatepurposes.rulesandregulationsonceoutofbounds,itwillcauseaviolationofthelegitimaterightsandinterestsofthestudents,includingthefollowing.
(Part1ofUniversityRegulationsprovidesthatstudentdress,behaviorunbecomingschoolExpulsion,whichisobviouslyhigherthanthegeneralrequirementsofthelegalcitizens,theremaybeviolationsoftheConstitutiongiventocitizensoftherighttoeducation.
