TheGeneralConferenceoftheUnitedNationsEducational,ScientificandCulturalOrganizationhereinafterreferredtoasUNESCO,meetinginParis,from29Septemberto17October2003,atits32ndsession,
Referringtoexistinginternationalhumanrightsinstruments,inparticulartotheUniversalDeclarationonHumanRightsof1948,theInternationalCovenantonEconomic,SocialandCulturalRightsof1966,andtheInternationalCovenantonCivilandPoliticalRightsof1966,
Consideringtheimportanceoftheintangibleculturalheritageasamainspringofculturaldiversityandaguaranteeofsustainabledevelopment,asunderscoredintheUNESCORecommendationontheSafeguardingofTraditionalCultureandFolkloreof1989,intheUNESCOUniversalDeclarationonCulturalDiversityof2001,andintheIstanbulDeclarationof2002adoptedbytheThirdRoundTableofMinistersofCulture,
Consideringthedeep-seatedinterdependencebetweentheintangibleculturalheritageandthetangibleculturalandnaturalheritage,
Recognizingthattheprocessesofglobalizationandsocialtransformation,alongsidetheconditionstheycreateforreneweddialogueamongcommunities,alsogiverise,asdoesthephenomenonofintolerance,togravethreatsofdeterioration,disappearanceanddestructionoftheintangibleculturalheritage,inparticularowingtoalackofresourcesforsafeguardingsuchheritage,
Beingawareoftheuniversalwillandthecommonconcerntosafeguardtheintangibleculturalheritageofhumanity,
Recognizingthatcommunities,inparticularindigenouscommunities,groupsand,insomecases,individuals,playanimportantroleintheproduction,safeguarding,maintenanceandre-creationoftheintangibleculturalheritage,thushelpingtoenrichculturaldiversityandhumancreativity,
Notingthefar-reachingimpactoftheactivitiesofUNESCOinestablishingnormativeinstrumentsfortheprotectionoftheculturalheritage,inparticulartheConventionfortheProtectionoftheWorldCulturalandNaturalHeritageof1972,
Notingfurtherthatnobindingmultilateralinstrumentasyetexistsforthesafeguardingoftheintangibleculturalheritage,
Consideringthatexistinginternationalagreements,recommendationsandresolutionsconcerningtheculturalandnaturalheritageneedtobeeffectivelyenrichedandsupplementedbymeansofnewprovisionsrelatingtotheintangibleculturalheritage,
Consideringtheneedtobuildgreaterawareness,especiallyamongtheyoungergenerations,oftheimportanceoftheintangibleculturalheritageandofitssafeguarding,
Consideringthattheinternationalcommunityshouldcontribute,togetherwiththeStatesPartiestothisConvention,tothesafeguardingofsuchheritageinaspiritofcooperationandmutualassistance,
RecallingUNESCO’sprogrammesrelatingtotheintangibleculturalheritage,inparticulartheProclamationofMasterpiecesoftheOralandIntangibleHeritageofHumanity,
Consideringtheinvaluableroleoftheintangibleculturalheritageasafactorinbringinghumanbeingsclosertogetherandensuringexchangeandunderstandingamongthem,
AdoptsthisConventiononthisseventeenthdayofOctober2003.
I.Generalprovisions
Article1–PurposesoftheConvention
ThepurposesofthisConventionare:
(a)tosafeguardtheintangibleculturalheritage;
(b)toensurerespectfortheintangibleculturalheritageofthecommunities,groupsandindividualsconcerned;
(c)toraiseawarenessatthelocal,nationalandinternationallevelsoftheimportanceoftheintangibleculturalheritage,andofensuringmutualappreciationthereof;
(d)toprovideforinternationalcooperationandassistance.
Article2–Definitions
ForthepurposesofthisConvention,
1.The“intangibleculturalheritage”meansthepractices,representations,expressions,knowledge,skills–aswellastheinstruments,objects,artefactsandculturalspacesassociatedtherewith–thatcommunities,groupsand,insomecases,individualsrecognizeaspartoftheirculturalheritage.Thisintangibleculturalheritage,transmittedfromgenerationtogeneration,isconstantlyrecreatedbycommunitiesandgroupsinresponsetotheirenvironment,theirinteractionwithnatureandtheirhistory,andprovidesthemwithasenseofidentityandcontinuity,thuspromotingrespectforculturaldiversityandhumancreativity.ForthepurposesofthisConvention,considerationwillbegivensolelytosuchintangibleculturalheritageasiscompatiblewithexistinginternationalhumanrightsinstruments,aswellaswiththerequirementsofmutualrespectamongcommunities,groupsandindividuals,andofsustainabledevelopment.
2.The“intangibleculturalheritage”,asdefinedinparagraph1above,ismanifestedinteraliainthefollowingdomains:
(a)oraltraditionsandexpressions,includinglanguageasavehicleoftheintangibleculturalheritage;
(b)performingarts;
(c)socialpractices,ritualsandfestiveevents;
(d)knowledgeandpracticesconcerningnatureandtheuniverse;
(e)traditionalcraftsmanship.
3.“Safeguarding”meansmeasuresaimedatensuringtheviabilityoftheintangibleculturalheritage,includingtheidentification,documentation,research,preservation,protection,promotion,enhancement,transmission,particularlythroughformalandnon-formaleducation,aswellastherevitalizationofthevariousaspectsofsuchheritage.
4.“StatesParties”meansStateswhichareboundbythisConventionandamongwhichthisConventionisinforce.
5.ThisConventionappliesmutatismutandistotheterritoriesreferredtoinArticle33whichbecomePartiestothisConventioninaccordancewiththeconditionssetoutinthatArticle.Tothatextenttheexpression“StatesParties”alsoreferstosuchterritories.
Article3–Relationshiptootherinternationalinstruments
NothinginthisConventionmaybeinterpretedas:
(a)alteringthestatusordiminishingthelevelofprotectionunderthe1972ConventionconcerningtheProtectionoftheWorldCulturalandNaturalHeritageofWorldHeritagepropertieswithwhichanitemoftheintangibleculturalheritageisdirectlyassociated;or
(b)affectingtherightsandobligationsofStatesPartiesderivingfromanyinternationalinstrumentrelatingtointellectualpropertyrightsortotheuseofbiologicalandecologicalresourcestowhichtheyareparties.
II.OrgansoftheConvention
Article4–GeneralAssemblyoftheStatesParties
1.AGeneralAssemblyoftheStatesPartiesisherebyestablished,hereinafterreferredtoas“theGeneralAssembly”.TheGeneralAssemblyisthesovereignbodyofthisConvention.
2.TheGeneralAssemblyshallmeetinordinarysessioneverytwoyears.ItmaymeetinextraordinarysessionifitsodecidesorattherequesteitheroftheIntergovernmentalCommitteefortheSafeguardingoftheIntangibleCulturalHeritageorofatleastone-thirdoftheStatesParties.
3.TheGeneralAssemblyshalladoptitsownRulesofProcedure.
Article5–IntergovernmentalCommitteefortheSafeguardingoftheIntangibleCulturalHeritage
1.AnIntergovernmentalCommitteefortheSafeguardingoftheIntangibleCulturalHeritage,hereinafterreferredtoas“theCommittee”,isherebyestablishedwithinUNESCO.Itshallbecomposedofrepresentativesof18StatesParties,electedbytheStatesPartiesmeetinginGeneralAssembly,oncethisConventionentersintoforceinaccordancewithArticle34.
2.ThenumberofStatesMembersoftheCommitteeshallbeincreasedto24oncethenumberoftheStatesPartiestotheConventionreaches50.
Article6–ElectionandtermsofofficeofStatesMembersoftheCommittee
1.TheelectionofStatesMembersoftheCommitteeshallobeytheprinciplesofequitablegeographicalrepresentationandrotation.
2.StatesMembersoftheCommitteeshallbeelectedforatermoffouryearsbyStatesPartiestotheConventionmeetinginGeneralAssembly.
3.However,thetermofofficeofhalfoftheStatesMembersoftheCommitteeelectedatthefirstelectionislimitedtotwoyears.TheseStatesshallbechosenbylotatthefirstelection.
4.Everytwoyears,theGeneralAssemblyshallrenewhalfoftheStatesMembersoftheCommittee.
5.ItshallalsoelectasmanyStatesMembersoftheCommitteeasrequiredtofillvacancies.
6.AStateMemberoftheCommitteemaynotbeelectedfortwoconsecutiveterms.
7.StatesMembersoftheCommitteeshallchooseastheirrepresentativespersonswhoarequalifiedinthevariousfieldsoftheintangibleculturalheritage.
Article7–FunctionsoftheCommittee
WithoutprejudicetootherprerogativesgrantedtoitbythisConvention,thefunctionsoftheCommitteeshallbeto:
(a)promotetheobjectivesoftheConvention,andtoencourageandmonitortheimplementationthereof;
(b)provideguidanceonbestpracticesandmakerecommendationsonmeasuresforthesafeguardingoftheintangibleculturalheritage;
(c)prepareandsubmittotheGeneralAssemb
